What is known about Global Business Mobility visas for entering the UK

Launch of the Global Business Mobility visa to enter the UK

The Global Business Mobility visa is scheduled to be launched in the spring of 2022. The permit will make it easier for workers to transfer to the UK from foreign companies.

Target applicants for the Global Business Mobility visa

The new type of visa will be suitable for five different categories of foreigners who will be able to obtain it to visit the UK:

  • leading and qualified employees who will be employed in the UK office of an overseas company;
  • trainees, employed at the UK branch as part of the training process;
  • employees seconded to UK companies;
  • service providers under trade contracts with the United Kingdom;
  • employees involved in the opening of the company's UK branches.

Companies with operating branches in the country will be suitable for graduate trainees and skilled workers, while those without branches will be suitable for service providers and business expansion workers. Any type of company will be able to issue a visa for a seconded worker. In all five cases, the employee needs the support of a sponsor, according to the Home Office.

Apparently, the Global Business Mobility visa will fulfill the objectives of existing visas:

  • transferring employees within the company (ICT and ICGT);
  • for a representative of a foreign company;
  • on a temporary international work contract.

The innovations will mostly affect employees on secondment and those taking part in the opening of new branches.

What's new in the visa route

Subsidiaries

Representative of an Overseas Business visa allows a foreign organization to send only one employee to the United Kingdom. The Global Business Mobility visa will allow companies to second a group of up to five people, that is, one manager and up to four employees. Unlike the Representative of an Overseas Business, the new visa requires a sponsor. It is not yet known how a firm without a UK branch can sponsor an employee trip. The MAC (Migration Advisory Committee) recommendations on financial support for employees make no mention of management.

Seconded employees

At the moment, employees of British export client companies can be sent on business trips on a Visitor visa. The new business visa will presumably be available for trips involving imports or exports in large volumes. MAC suggests that transactions above the 50,000,000 GBP threshold should be considered as such.

Sponsorship

The sponsor is expected to be a company that hosts foreign employees in the UK. Visa applicants will need to confirm that they have a parent and host organization, which maintains a business partnership with each other. For example, a parent firm from any country in the world can send its employees to a subsidiary in the United Kingdom, and a foreign organization will also have the opportunity to second staff to a supplier of goods.

Duration of visa

The period of stay of a foreigner under the Global Business Mobility visa is still up in the air. Each route under the new visa has its own limitations and allows a stay of 6 months or more.

MAC stated that the Intra Company Transfer visa lost its advantages over the Skilled Worker permit category. The committee recommended that Intra Company Transfer visa holders be allowed to obtain permanent residence. As for employees of foreign companies, it was suggested that they be limited to two years on the new visa.

A solution to this issue could be giving the Global Business Mobility visa a temporary status, and then allowing immigrants to switch to the Skilled Worker category to get permanent residency.The time of stay on the new visa could be included in the total period for permanent residence, without having to count again after the change of category.
